Using SplashTone

While using the Site, you will not:

• violate any laws

• use the Site if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Site;

• fail to fulfill an agreement you have made with another user for which they have made a payment to you (for example, accepting a deposit for a performance for which you do not appear).  If you fail to fulfill an agreement for which you have been paid by another user, you must refund that user's payment within five (5) days. 

• post false, inaccurate, misleading, defamatory, or libelous content (including personal information)
  

• transfer your SplashTone account and User ID to another party without our consent;

• distribute or post spam, chain letters, or pyramid schemes;

• distribute viruses or any other technologies that may harm SplashTone, or the interests or property of SplashTone users;

Abusing SplashTone

SplashTone and the user community work together to keep the Site working properly and the community safe. Please report problems, offensive content, and policy violations to us.

Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep users off the Site if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies.

Account Rights

You agree that SplashTone.com may remove content considered objectionable by SplashTone.com, and your account may be suspended if you engage in activities we deem inappropriate, even if not outlined in this document, at our sole discretion. 

Content

You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service, or transmit to other Members.  Opinions, advice, statements, offers, or other information or content made available through the Service, but not directly by SplashTone.com or Open Bracket, LLC are those of their respective authors and not of SplashTone.com or Open Bracket, LLC, and should not necessarily be relied upon. Such authors are solely responsible for such content. SplashTone.com or Open Bracket, LLC do not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than SplashTone.com or Open Bracket, LLC. Under no circumstances will SplashTone.com or Open Bracket, LLC be responsible for any loss or damage resulting from any reliance on information or other content posted on SplashTone.com or Open Bracket, LLC service, or transmitted to SplashTone.com members.

You agree that SplashTone.com or Open Bracket, LLC have no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that SplashTone.com reserves the right to remove accounts that are inactive for an extended period of time.

The following is a partial list of the kind of Content that is illegal or prohibited on the Website. SplashTone.com reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending content from the Service and terminating the membership of such violators. It includes Content that:

• is patently offensive to the online community, such as Content that promotes solicitation, racism, bigotry, hatred or physical harm of any kind against any group or individual;
• harasses or advocates harassment of another person;
• involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming"
• promotes information that you know is false, misleading or deceitful or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
• promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, or providing pirated music or links to pirated music files;
• contains script tags (<script></script>), especially JAVA, or an overabundance of any code that is likely to, or is designed to inhibit, lock out, crash or otherwise cause damage to other members' computers.
• solicits passwords or personal identifying information for commercial or unlawful purposes from other users
• engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Content License

When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future. (We need these rights to host and display your content.)
